My Friend Just Got Arrested! What Do I Do Now?

You get the dreaded 2 AM phone call—your friend is in jail. What can you do to help?

Stay calm. He or she is probably terrified at the moment, and you need to be a reassuring presence.

The first thing you need to do is to encourage your friend not to answer any questions or to discuss the case with anyone. Your friend shouldn’t even tell you anything about what happened—be sure to warn him or her at the beginning of the conversation. They should also avoid saying anything about the case to relatives or anyone else if there is someone in the area who might overhear the conversation. The second thing is to tell your friend to ask for a lawyer instead of answering the police’s questions. And the third thing is to get as much information as you can: where they are at that moment, the charge (though you shouldn’t let your friend tell you what happened), and the bond amount if this has been determined.

Then, connect him or her with an attorney who specializes in criminal defense. Give the lawyer all the information you have. It’s extremely important that your friend hires an experienced attorney as quickly as possible – Job #1 is to get them out of jail as soon as possible! And just because they have been arrested doesn’t mean that they will be formally charged with a crime. The sooner your friend has counsel, the better off he or she will be.

It’s important to reiterate that simply being arrested does not guarantee that the prosecution will go forward with criminal charges. So your friend doesn’t need to panic.
